These Terms of Service ("Terms") govern your access to and use of the Simple Shed Marketing website, services, and any related communications (collectively, the "Services"). By using our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Simple Shed Marketing is a service operated by Amplify Digital Marketing LLC, a Florida limited liability company with its principal place of business at 3439 Skysail Place, Tampa, FL 33607. We provide done-for-you marketing services designed specifically for shed businesses, including content creation, filming, social media management, paid advertising, CRM setup, and lead generation.
You must be at least 18 years old and authorized to enter into agreements on behalf of your business to use our Services. By engaging with us, you represent that you meet these requirements.
Specific deliverables, timelines, pricing, and scope are defined in a separate service agreement, proposal, or written engagement letter. These Terms apply in addition to any such agreement. In the event of a conflict, the specific service agreement will control.
Our packages may include, depending on the plan selected:
Service fees begin at $399/month and vary based on the scope of the package selected. Fees are billed monthly in advance unless otherwise agreed in writing. Ad spend for paid campaigns is billed separately by the ad platform and is the client's responsibility.
Payments are non-refundable except as required by law or expressly stated in a written agreement. Late payments may result in service pause until the account is brought current.

All content, designs, code, and materials created by Simple Shed Marketing during the engagement remain our intellectual property until full payment is received. Once paid in full, you receive a non-exclusive license to use the content in connection with your business.
You retain ownership of your brand assets, logos, and any materials you provide to us. You grant us a license to use them for the purpose of delivering the Services and, unless you tell us otherwise in writing, for portfolio and case study purposes.
Our Services rely on third-party platforms including Meta (Facebook & Instagram), Google, and CRM providers. We are not responsible for outages, account suspensions, algorithm changes, or policy decisions made by these platforms. We will work with you to resolve issues but cannot guarantee outcomes controlled by third parties.
Marketing performance depends on many factors including your local market, offer, pricing, seasonality, and follow-up practices. While we work hard to deliver strong results and have a track record of success, we do not guarantee a specific number of leads, appointments, or sales. Testimonials shown on our website reflect individual client experiences and are not a promise of similar results.
By providing your contact information, you agree that we may contact you by email, phone, or SMS regarding your inquiry, active projects, and service updates. Marketing communications require separate opt-in and can be withdrawn at any time. See our Privacy Policy and SMS Terms for details.
Both parties agree to keep confidential any non-public business information shared during the engagement, including strategies, financials, customer data, and internal processes. This obligation continues after the engagement ends.
Either party may end the engagement with 30 days' written notice unless otherwise agreed in a specific service agreement. Fees for the current billing period are non-refundable. Upon termination, we will hand off any active campaigns and provide reasonable transition support.
To the fullest extent permitted by law, Simple Shed Marketing's total liability for any claim arising out of or related to the Services shall not exceed the amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business opportunities.
You agree to indemnify and hold Simple Shed Marketing harmless from any claims, damages, or expenses arising from your use of the Services, your breach of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the United States and the state in which Simple Shed Marketing is based, without regard to conflict of law principles. Any disputes will be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of that jurisdiction.
We may update these Terms from time to time. Changes take effect when posted on this page with an updated "Last updated" date. Continued use of the Services after changes are posted means you accept the updated Terms.
